The Australian Court of Appeal has set a precedent which is both serious (and incredibly funny) at the same time.
They have apparently been listening to Lindsay on the radio, and reading solopassion.com, because they have gone down the "you do not have a right not to be offended" road and ruled (quite rightly) that portraying someone as 'demented' is not defamatory. Some silly gal... (aren't they all females who believe this sort of thing) ...called Therese Mallik, head of some busybody residents action group in Cressnock, New South Wales, made a submission to the Land and Environment Court opposing an application by a Crematorium in Cressock to increase the number of cremations. The basis for her submission was that she had...*snigger*...seen ghosts flying around the Crematorium. The local paper reported this in an hilarious article which made her seem demented and she sued. The Jury members (correctly) found for the paper on the grounds that although the article made her seem demented it was not defamatory, and her appeal against this was dismissed. You really do have to wonder about some of these Australians and their beliefs in ghosts and other witchcraft....probably about time solopassion.com did a recruitment drive over there to instill a bit of rationality into the lucky country.
